  1. These General Terms and Conditions apply to all offers made by The Padel Industry and to all agreements entered into with The Padel Industry.

  2. In addition to these General Terms and Conditions, additional terms may apply to certain services and/or products where expressly stated. In the event of any conflict between the additional terms and these General Terms and Conditions, the additional terms shall generally prevail unless expressly stated otherwise.

  3. Any deviation from one or more provisions of these General Terms and Conditions is only valid if agreed upon in writing. In such cases, all remaining provisions shall remain fully applicable.

  4. Any general terms and conditions of the Buyer shall not apply unless expressly accepted in writing by The Padel Industry.

  5. The websites of The Padel Industry are intended exclusively for the Dutch and Belgian markets.

  6. The Padel Industry reserves the right to amend and/or supplement these General Terms and Conditions.

  7. By using the websites of The Padel Industry and/or placing an order, the Buyer accepts these General Terms and Conditions as well as all other rights and obligations stated on the website.

  8. The Padel Industry is entitled to engage third parties in the performance of an agreement with the Buyer.

2. Offers and Formation of Agreements

  1. Offers or quotations should be regarded as invitations to potential Buyers to make an offer. The Padel Industry shall not be bound by such offers or quotations unless this has been explicitly and unambiguously confirmed in writing. Acceptance of the invitation by the potential Buyer constitutes an offer and shall only result in an agreement if the other provisions of this article have been complied with.

  2. Offers are valid while stocks last.

  3. A personalized quotation is valid for two (2) weeks unless otherwise stated.

  4. An offer by the potential Buyer as referred to in Article 2.1 shall be deemed to have been made in one of the following situations:

  • the potential Buyer has entered the required information on the website and submitted it electronically to The Padel Industry via the order form, and The Padel Industry has received it;

  • the potential Buyer has expressly indicated during a visit to The Padel Industry's store that they wish to purchase a specific product and/or service;

  • the potential Buyer has expressly indicated by telephone that they wish to receive a specific product and/or service;

  • a quotation signed by the Buyer has been received by The Padel Industry.

  1. An agreement is concluded once an order confirmation has been provided by The Padel Industry or sent by email to the email address provided by the Buyer. The Padel Industry may revoke the agreement if the Buyer does not meet, or has previously failed to meet, certain conditions. In such a case, the Buyer will be informed within ten (10) days after receipt of the order.

  2. The Buyer and The Padel Industry expressly agree that agreements may also be validly concluded through electronic communication. The absence of a physical signature does not affect the validity of the agreement. The electronic records of The Padel Industry shall, to the extent permitted by law, serve as evidence.

  3. Information, images, and communications relating to offers and products are presented as accurately as possible. However, The Padel Industry does not guarantee that all information corresponds completely with reality. Deviations shall in principle not entitle the Buyer to compensation or termination of the agreement.

  4. If The Padel Industry is unable to deliver within 30 days, the Buyer has the right to terminate the agreement. The Buyer must contact The Padel Industry to exercise this right.

3. Prices

  1. All prices are stated in euros and include VAT.

  2. Special offers are valid while stocks last.

  3. The Buyer is required to pay the price confirmed by The Padel Industry in accordance with Article 2.5. Obvious errors, such as typographical errors or manipulation errors, may be corrected by The Padel Industry even after the agreement has been concluded.

  4. Delivery costs are not included and will be displayed during checkout before payment. Different rates may apply to deliveries outside the Netherlands and Belgium. These rates will be clearly communicated.

  5. If product prices increase between the time the order is placed and the agreement is fulfilled, the Buyer may terminate the agreement within ten (10) days after being notified of the price increase.

4. Payment

  1. Payment may be made using the following methods:

  • Credit card (VISA, Mastercard)

The Padel Industry may expand the available payment methods and will communicate any changes on the website.

  3. Credit card payments are subject to the terms and conditions of the relevant card issuer. The Padel Industry is not a party to these terms.

  4. In the event of non-payment or late payment, the Buyer shall owe interest of 1.44% per month on the outstanding amount. Part of a month shall be considered a full month.

  5. All judicial and extrajudicial costs incurred by The Padel Industry as a result of the Buyer's failure to pay shall be borne by the Buyer.

5. Delivery and Delivery Times

  1. Orders will be delivered as quickly as possible. The Padel Industry aims to dispatch orders placed on business days before 10:00 PM on the same day. The maximum delivery period is 30 days. Any delivery times stated are indicative.

  2. If a product is temporarily out of stock, an indication will be provided of when it is expected to become available again. Delays will be communicated within one business day.

  3. Delivery will take place at the address provided by the Buyer. Additional requirements may apply to credit card payments.

  4. Once the products have been delivered to the specified address, the risk passes to the Buyer.

  5. Different conditions may apply to deliveries outside the Netherlands.

  2. A Buyer who is not a Consumer Buyer may not return products without a valid reason. If they nevertheless do so, all associated costs shall be borne by the Buyer.

7. Right of Withdrawal and Exchanges

  1. The Consumer Buyer has the right to withdraw from the agreement within fourteen (14) days after delivery. The product and packaging must be in their original, undamaged, and unused condition and must include all documentation and warranty certificates.

  2. The Padel Industry shall not be liable for damage to or loss of returned goods during return shipping.

  3. Custom-made or personalized products cannot be exchanged or returned.

  4. If a product is specially ordered at the Buyer's request and is not part of The Padel Industry's standard inventory, The Padel Industry reserves the right to charge 10% of the order value in the event of cancellation or return.

  5. If the product does not meet the return conditions, the purchase price will not be refunded and the product shall remain the property of the Buyer.

8. Retention of Title

Ownership of the products shall only transfer to the Buyer once full payment has been received. Until that time, the Buyer may not pledge, sell, transfer, or otherwise dispose of the products.

9. Warranty and Liability

  1. Warranty conditions are those provided by the manufacturer. Complaints must be reported within five months after the defect has been discovered.

  2. The Padel Industry shall only be liable in cases of intent or gross negligence and shall never be liable for consequential damages or loss of profit.

  3. Any compensation shall be limited to the invoice value of the relevant product.

  4. The warranty shall not apply in cases of normal wear and tear, repairs carried out by the Buyer or third parties, improper use, or damage caused by negligence.
